Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Trackio platform ("Service"), operated by Trackio ("we", "our", "us"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Trackio, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Trackio on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Services

Trackio provides an influencer campaign management platform that enables brands, agencies, and subscription apps to manage creator deals, track content performance across social media platforms, calculate billing (CPM, flat rate, and performance-based deals), process payments to creators, and generate campaign reports.

3. Accounts & Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

Workspace administrators are responsible for managing team member access and permissions within their workspace.

4. Subscriptions & Billing

Trackio offers the following subscription plans:

  • Starter: $299/month (or $239/month billed annually)
  • Growth: $499/month (or $399/month billed annually)
  • Unlimited: $999/month (or $799/month billed annually)

Subscriptions are billed in advance on a monthly or annual basis. All payments are processed through Stripe. Prices are in USD and exclude applicable taxes. We reserve the right to change pricing with 30 days written notice.

Subscriptions automatically renew at the end of each billing period unless cancelled. Annual subscriptions renew at the then-current annual rate.

5. Free Trial

New accounts receive a 14-day free trial with access to all features. No credit card is required to start a trial. At the end of the trial period, your account will be restricted until you subscribe to a paid plan. Trial accounts that are not converted to paid subscriptions may be deleted after 90 days of inactivity.

6. Cancellation

You may cancel your subscription at any time through the Settings page. Upon cancellation:

  • Your subscription remains active until the end of the current billing period
  • You will not be charged for subsequent billing periods
  • We do not offer partial refunds for unused time within a billing period
  • Your data is retained for 90 days after cancellation, after which it is permanently deleted
  • You may reactivate your account at any time during the 90-day retention period

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Scrape, harvest, or collect data from the Service by automated means
  • Upload malicious code, viruses, or harmful content
  • Impersonate another person or entity
  • Use the Service to send spam or unsolicited communications
  • Resell or redistribute the Service without our written permission

8. Creator Data Responsibility

When you add creators to your workspace and manage their data on Trackio, you are responsible for:

  • Obtaining appropriate consent from creators to store and process their data
  • Ensuring accuracy of creator information you upload or enter
  • Complying with applicable data protection laws in your jurisdiction
  • Honouring any data deletion requests from creators in your workspace

Trackio acts as a data processor on your behalf. You remain the data controller for creator data within your workspace.

9. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by Trackio and protected by intellectual property laws. You retain ownership of all data you upload to the Service. By using Trackio, you grant us a limited license to process your data as necessary to provide the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Trackio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

11. Indemnification

You agree to indemnify and hold harmless Trackio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of England and Wales.

13. Changes to Terms

We may modify these Terms at any time. We will provide at least 30 days notice of material changes via email or a prominent notice on the Service. Your continued use of Trackio after changes take effect constitutes acceptance of the updated Terms.
